The purchaser raised requisitions as to the whereabouts of some title deeds which relate exclusively to the property but were more than 15 years old. The vendor could not locate them because they had never come into his possession. As a result of his inability to produce the title deeds, the vendor failed to give title to the Purchaser.
We provided a policy to the purchaser agreeing to indemnify loss resulting from the inability to produce those title deeds relating exclusively to the Property. Completion then took place as scheduled.
